This Privacy Policy for Personal Data (hereinafter referred to as the “Privacy Policy”) applies to all information that the Business Innovation College website (hereinafter referred to as the “Website”), located on the domain name bicollege.ae, may obtain about the User during the use of the website bicollege.ae, its programs, and its products.

1. DEFINITIONS

1.1. The following terms are used in this Privacy Policy:

1.1.1. “Operator” — Individual Entrepreneur IGLIKOV FINANCIAL SCHOOL, who organizes and/or carries out the processing of personal data, and also determines the purposes of processing personal data, the composition of personal data to be processed, and the actions (operations) performed with personal data.

1.1.2. “Personal Data” — Any information relating to a directly or indirectly identified or identifiable individual (personal data subject).

1.1.3. “Processing of Personal Data” — Any action (operation) or set of actions (operations) performed with personal data using automation tools or without using such tools, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), anonymization, blocking, deletion, destruction of personal data.

1.1.4. “Confidentiality of Personal Data” — A mandatory requirement for the Operator or any other person who has gained access to personal data not to allow their distribution without the consent of the personal data subject or other legal grounds.

1.1.5. “Website” — A set of interconnected web pages hosted on the Internet at the unique address (URL): https://bicollege.ae/.

1.1.6. “User” — A person who has access to the Website via the Internet and uses the information, materials, and products of the Website.

1.1.7. “Cookies” — A small piece of data sent by a web server and stored on the user’s computer, which the web client or web browser sends back to the web server in an HTTP request each time an attempt is made to open a page of the respective website.

1.1.8. “IP Address” — A unique network address of a node in a computer network through which the User accesses the Website.

2. GENERAL PROVISIONS

2.1. Use of the Website by the User constitutes acceptance of this Privacy Policy and the terms of processing the User’s personal data.

2.2. If the User disagrees with the terms of the Privacy Policy, they must cease using the Website.

2.3. This Privacy Policy applies to the Business Innovation College Website. The Website does not control and is not responsible for third-party websites to which the User may be redirected via links available on the Website.

2.4. The Operator does not verify the accuracy of personal data provided by the User.

3. SUBJECT OF THE PRIVACY POLICY

3.1. This Privacy Policy establishes the Operator’s obligations regarding non-disclosure and ensuring the confidentiality regime for personal data that the User provides when registering on the Website, placing an order, paying for Courses, or subscribing to an informational newsletter.

3.2. Personal data authorized for processing under this Privacy Policy is provided by the User by filling out forms on the Website and includes the following information:

3.2.1. User’s last name, first name, patronymic;

3.2.2. Email address (e-mail);

3.2.3. Training data (progress, test and assignment results);

3.2.4. Technical data (IP address, cookie information, browser and device type).

3.3. The Website protects Data that is automatically transmitted when visiting pages:

– IP address;

– Cookie information;

– Browser information;

– Access time;

– Referrer (address of the previous page).

3.3.1. Disabling cookies may result in the inability to access parts of the Website that require authorization.

3.3.2. The Website collects statistics on the IP addresses of its visitors. This information is used to prevent, detect, and resolve technical issues.

4. PURPOSES OF COLLECTING PERSONAL INFORMATION OF THE USER

4.1. The Operator may use the User’s personal data for the following purposes:

4.1.2. Providing the User with access to personalized data on the Website and Courses.

4.1.3. Establishing feedback with the User, including sending notifications and requests regarding the use of the Website, processing User requests and applications.

4.1.4. Determining the User’s location to ensure security and prevent fraud.

4.1.5. Confirming the accuracy and completeness of personal data provided by the User.

4.1.6. Creating an account (Personal Account) for using Courses.

4.1.7. Notifying the User via email.

4.1.8. Providing the User with effective technical support in case of problems related to the use of the Website.

4.1.9. Providing the User, with their consent, with special offers, newsletters, and other information on behalf of Business Innovation College.

5. METHODS AND TERMS OF PROCESSING PERSONAL INFORMATION

5.1. Processing of the User’s personal data is carried out without time limitation, by any lawful means, including in personal data information systems using automation tools or without using such tools.

5.2. The User’s personal data may be transferred to authorized state bodies of the Republic of Kazakhstan only on the grounds and in the manner established by the legislation of the Republic of Kazakhstan.

5.3. In case of loss or disclosure of personal data, the Operator has the right not to inform the User about the loss or disclosure of personal data.

5.4. The Operator takes necessary organizational and technical measures to protect the User’s personal information from unlawful or accidental access, destruction, alteration, blocking, copying, distribution, and other unlawful actions by third parties.

5.5. The Operator, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User’s personal data.

6. RIGHTS AND OBLIGATIONS OF THE PARTIES

6.1. The User has the right to:

6.1.1. Make a free decision on providing their personal data necessary for using the Website and give consent to its processing.

6.1.2. Update or supplement the provided personal data information in case of changes to such information.

6.1.3. Receive information from the Operator regarding the processing of their personal data. The User has the right to demand from the Operator clarification of their personal data, blocking or destruction if the personal data is incomplete, outdated, inaccurate, unlawfully obtained, or not necessary for the stated purpose of processing, as well as to take measures provided by law to protect their rights. To do this, it is sufficient to notify the Operator at support@bicollege.ae.

6.2. The Operator is obliged to:

6.2.1. Use the received information exclusively for the purposes specified in clause 4 of this Privacy Policy.

6.2.2. Ensure the storage of confidential information in secrecy, not to disclose it without the prior written consent of the User, and also not to sell, exchange, publish, or disclose the transferred personal data of the User in any other possible way, except as provided in clause 5.2 of this Privacy Policy.

6.2.3. Take precautions to protect the confidentiality of the User’s personal data in accordance with the procedure usually used to protect such information in existing business practice.

6.2.4. Block personal data relating to the respective User from the moment of the User’s or their legal representative’s appeal or request, or from an authorized body for the protection of personal data subjects’ rights, for the period of verification in case of detection of inaccurate personal data or unlawful actions.

7. LIABILITY OF THE PARTIES

7.1. The Operator that has failed to fulfill its obligations shall be liable for losses incurred by the User in connection with the unlawful use of personal data in accordance with the legislation of the Republic of Kazakhstan, except in cases provided for in clauses 5.2 and 7.2 of this Privacy Policy.

7.2. In case of loss or disclosure of Confidential Information, the Operator shall not be liable if such confidential information:

7.2.1. Became public knowledge before its loss or disclosure.

7.2.2. Was obtained from a third party before its receipt by the Operator.

7.2.3. Was disclosed with the User’s consent.

7.3. The User bears full responsibility for compliance with the requirements of the legislation of the Republic of Kazakhstan, including laws on advertising, protection of copyright and related rights, protection of trademarks and service marks, including full responsibility for the content and form of materials.

8. DISPUTE RESOLUTION

8.1. Before filing a lawsuit in court regarding disputes arising from relations between the User and the Operator, it is mandatory to present a claim (a written proposal or an electronic proposal for voluntary dispute resolution).

8.2. The recipient of the claim, within 10 (ten) calendar days from the date of receipt of the claim, shall notify the claimant in writing or electronically of the results of the claim review.

8.3. If no agreement is reached, the dispute shall be referred to the Specialized Interdistrict Economic Court of Astana.

8.4. The current legislation of the Republic of Kazakhstan applies to this Privacy Policy and relations between the User and the Operator.

9. ADDITIONAL PROVISIONS

9.1. The Operator has the right to make changes to this Privacy Policy without the User’s consent.

9.2. The new Privacy Policy comes into force from the moment it is posted on the Website, unless otherwise provided by the new version of the Privacy Policy.
